These Terms of Service (“Terms”) govern your access to and use of the Evren website, online store, products, customer accounts, product-registration services, support services, and related programs (collectively, the “Services”).

The Services are operated by Lumico LLC, doing business as Evren (“Evren,” “we,” “us,” or “our”).

By visiting our website, placing an order, creating an account, registering a product, or otherwise using the Services, you agree to these Terms. If you do not agree to these Terms, please do not use the Services.

1. Eligibility and use of the Services

You may use the Services only for lawful purposes.

If you place an order, create an account, or otherwise enter into an agreement with Evren, you represent that you are legally able to do so in your jurisdiction.

You may not use the Services to:

  • violate any applicable law or regulation;

  • commit or facilitate fraud;

  • interfere with the operation or security of the Services;

  • attempt to gain unauthorized access to another person's account or to our systems;

  • transmit malicious code;

  • scrape, harvest, or collect information through unauthorized means;

  • impersonate another person;

  • infringe another person's intellectual-property or privacy rights; or

  • abuse an Evren warranty, refill, promotion, or support program.

2. Shopify and our online store

Our online store is hosted by Shopify.

Shopify provides technology and services that allow us to operate our store, including ecommerce, checkout, customer-account, fraud-prevention, analytics, personalization, advertising, and related functionality.

When you visit or make a purchase from our store, Shopify collects and processes personal information relating to your interactions with our store.

Depending on the Shopify services and settings in use, Shopify may process information from your interactions with Evren together with information from your interactions with Shopify and with other merchants in order to provide, improve, personalize, secure, analyze, and advertise Shopify services and merchant stores.

Information relating to your use of our Services may be shared with Shopify and with other service providers that assist us or Shopify. Those companies may process information in countries other than the country where you live.

3. Products and product information

We make reasonable efforts to describe and display Evren products accurately.

However, product colors may appear differently depending on your display or device, and minor differences in packaging or product appearance may occur.

Product descriptions, specifications, features, packaging, components, colors, and availability may change from time to time.

We may introduce, update, replace, or discontinue products and accessories when reasonably necessary.

4. Orders

Submitting an order constitutes an offer to purchase the products in that order.

We may accept, reject, limit, or cancel an order when reasonably necessary, including because of:

  • product availability;

  • suspected fraud or unauthorized activity;

  • payment problems;

  • inaccurate or incomplete order information;

  • pricing or product-information errors;

  • shipping restrictions; or

  • order quantities or activity that reasonably appear fraudulent or abusive.

If we cancel an order after payment has been collected, we will refund the amount charged for the canceled portion of the order.

Please review your order carefully before submitting it.

5. Prices, payments, and taxes

Unless otherwise stated, prices displayed on our U.S. store are in U.S. dollars.

Prices and promotions may change from time to time. Changes will not affect an order we have already accepted except where necessary to correct an obvious error.

You agree to provide accurate and current billing and payment information.

Payments are processed through Shopify and/or third-party payment providers.

Applicable taxes and charges will be displayed at checkout when required.

6. Shipping and delivery

Orders are subject to our Shipping Policy, which is incorporated into these Terms by reference.

Shipping and delivery dates are estimates unless we expressly state otherwise.

We are not responsible for delays caused by carriers, severe weather, natural events, government actions, incorrect customer-provided information, or other circumstances reasonably outside our control, although we will provide the assistance described in our Shipping Policy.

7. Returns and refunds

Returns, exchanges, cancellations, and refunds are governed by our Return and Refund Policy, which is incorporated into these Terms by reference.

8. Forever Guarantee

Eligible Evren products are supported by the Evren Forever Guarantee.

The Forever Guarantee is a separate written limited warranty and is governed by the Evren Forever Guarantee — Limited Warranty applicable to the covered product.

Nothing in these Terms limits rights or remedies expressly provided by the Forever Guarantee or rights that cannot legally be waived or limited.

9. Forever Heads

Eligible Evren toothbrushes include participation in the Forever Heads program.

Forever Heads is governed by the separate Forever Heads Program Terms applicable to the registered toothbrush handle.

Forever Heads is not an automatically renewing subscription and does not involve recurring refill charges.

10. Product registration

Registration is required to access certain Evren benefits, including Forever Guarantee service and Forever Heads refills.

You agree to provide accurate registration information, including accurate product and serial-number information.

You are responsible for keeping relevant contact and shipping information current.

Registration does not eliminate any proof-of-purchase requirement that may apply under the applicable program terms.

11. Customer accounts

You may have the option to create an Evren or Shopify-powered customer account.

You are responsible for keeping your account credentials confidential and for activity occurring through your account.

If you believe someone has accessed your account without authorization, please contact us.

We may restrict or suspend an account when reasonably necessary to address fraud, abuse, security concerns, or a material violation of these Terms.

12. Product use and oral-care information

Evren products should be used in accordance with the instructions, warnings, and safety information supplied with the product.

Information provided through our website regarding brushing, oral care, product use, or related topics is provided for general informational purposes and is not medical or dental advice.

Evren's website and customer support are not substitutes for advice from a dentist, physician, or other qualified healthcare professional.

If you experience persistent pain, bleeding, irritation, sensitivity, or another health concern, consult an appropriate healthcare professional.

13. Promotions and discount codes

Promotions, discount codes, bundles, giveaways, and special offers may be subject to additional terms.

Unless otherwise stated:

  • promotions may be limited by product, customer, geography, or time period;

  • discount codes have no cash value;

  • promotions cannot be combined unless expressly permitted; and

  • we may cancel or correct a promotion affected by an obvious pricing, technical, or administrative error.

14. Reviews, feedback, and submissions

If you submit a review, photograph, video, testimonial, suggestion, feedback, or other content to Evren, you represent that you have the right to provide it and that the content does not violate another person's rights.

You retain ownership of content you own.

When you submit content to us for publication or promotional use, you grant Evren a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, publish, and distribute that content for the purposes for which it was submitted, subject to applicable law.

We may remove content that is unlawful, fraudulent, deceptive, abusive, infringing, or otherwise inappropriate.

We will not condition legally required warranty service on providing a positive review.

15. Intellectual property

The Evren website and its content, including the Evren name and logos, product names, website design, photographs, graphics, videos, copy, illustrations, software, and other materials, are owned by Evren or our licensors and are protected by applicable intellectual-property laws.

You may access and use the website for lawful personal purposes.

No other license or ownership right is granted unless we expressly agree otherwise in writing.

16. Third-party services and links

Our Services may contain links to or integrations with websites, apps, payment providers, social platforms, or other services operated by third parties.

Those services are controlled by their respective providers and may be governed by separate terms and privacy policies.

Evren is not responsible for the content, availability, security, or practices of third-party services that we do not control.

17. Errors and corrections

Occasionally, information on our website may contain typographical errors, inaccuracies, or omissions relating to products, pricing, promotions, availability, shipping, or other matters.

We may correct errors and update information when reasonably necessary.

If an error materially affects an order that you have already placed, we will provide an appropriate correction, cancellation, or refund as required by applicable law.

18. Disclaimer of website and service warranties

Except for warranties expressly provided by Evren in writing, including the Forever Guarantee where applicable, the website and online Services are provided on an “as available” basis to the fullest extent permitted by applicable law.

Nothing in these Terms excludes or limits any warranty, consumer-protection right, or remedy that cannot legally be excluded or limited.

19. Limitation of liability

To the fullest extent permitted by applicable law, Lumico LLC and Evren will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising out of or relating to the use of, or inability to use, the website or Services.

This limitation does not apply where liability cannot legally be excluded or limited.

Nothing in this section reduces the remedies expressly provided by the Evren Forever Guarantee Limited Warranty or any mandatory rights available under applicable consumer-protection law.

20. Misuse of the Services

To the extent permitted by law, you are responsible for losses or claims resulting from your unlawful use of the Services, your material violation of these Terms, or your infringement of another person's rights.

21. Suspension and termination

You may stop using the Services at any time.

We may suspend or terminate access to an account or Service when reasonably necessary to address fraud, intentional abuse, unlawful conduct, security concerns, or a material violation of these Terms.

Termination of website or account access does not eliminate rights or obligations that arose before termination.

Valid Forever Guarantee or Forever Heads benefits continue according to their separate applicable terms.

22. Changes to these Terms

We may update these Terms from time to time to reflect changes to our Services, business practices, technology, or legal obligations.

When we make changes, we will update the “Last updated” date above and provide additional notice when required by law.

Changes to these Terms will not retroactively eliminate rights already earned under the Forever Guarantee, Forever Heads, or another express written Evren commitment.

23. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect.

24. No waiver

Our failure to enforce a provision of these Terms on one occasion does not waive our right to enforce that provision or another provision later.

25. Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles, except where applicable consumer-protection law requires otherwise.

Nothing in these Terms deprives you of mandatory rights provided by laws that apply to you.

26. Entire agreement

These Terms, together with the policies and program terms expressly incorporated into them, constitute the agreement between you and Evren regarding your use of the Services.

Separate written terms applicable to a particular product, warranty, promotion, or program control if they conflict with these general Terms regarding that specific subject.
